TERMS AND CONDITIONS

These Terms and Conditions (“Terms”, “Agreement”, or “Terms and Conditions”) govern access to and use of SugarBabyOnline.com, including its website, applications, software, communication tools, Creator features, subscription services, payment functionality, content hosting, and any other services provided by Sugar Baby Online (collectively, the “Platform”).

By creating an account, accessing, browsing, purchasing, subscribing to, uploading content to, communicating through, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

If you do not agree to these Terms, you must not access or use the Platform.

1. PLATFORM IDENTIFICATION

2. ACCEPTANCE OF THESE TERMS

By creating an account or using the Platform, you represent and warrant that:

1. You are at least 18 years old.
2. You have legal capacity to enter into this Agreement.
3. The information you provide is accurate and truthful.
4. You will comply with these Terms.
5. You will comply with applicable laws and regulations.
6. You have read and agree to the Privacy Notice.
7. You understand that Sugar Baby Online is a technology platform.
8. You understand that Sugar Baby Online is not a party to private relationships or agreements between users.
9. You understand that interactions with other users involve inherent risks.

If you do not satisfy these requirements, you may not use the Platform.

3. AGE REQUIREMENT — 18+

SugarBabyOnline is strictly limited to individuals who are at least eighteen (18) years old.

The Platform is an adults-only service.

The following activities are strictly prohibited:

• registering while under 18;
• creating an account for a minor;
• allowing a minor to use an account;
• allowing another person to use your account;
• requesting content from a minor;
• uploading content involving minors;
• purchasing content involving minors;
• sharing content involving minors;
• facilitating access to the Platform by a minor;
• attempting to circumvent age verification;
• using false information to access the Platform;
• grooming or soliciting minors;
• exploiting minors; or
• creating, requesting, purchasing, possessing, distributing, or facilitating Child Sexual Abuse Material (“CSAM”).

All persons appearing in sexual or sexually explicit Creator Content must be at least eighteen (18) years old at the time the content was created and must have provided the legally required consent for its creation and distribution.

Sugar Baby Online has zero tolerance for sexual exploitation of minors.

If the Company reasonably suspects that an account belongs to a person under 18, or that prohibited material involving a minor has been uploaded or distributed, it may immediately restrict or terminate the account, remove or restrict content, preserve relevant information, and take any action required or permitted by law.

Where legally required or appropriate, Sugar Baby Online may report suspected child exploitation, CSAM, trafficking, or other unlawful conduct to competent authorities.

4. IDENTITY AND AGE VERIFICATION

Sugar Baby Online may require users, and particularly Creators, to complete identity, age, liveness, or other verification procedures.

Verification may include:

• government-issued identification, including an INE, passport, driver’s license, or other legally valid identification;
• photographs or scans of identification documents;
• selfies or photographs taken for identity verification;
• facial matching or facial verification;
• liveness verification;
• date-of-birth verification;
• electronic signatures;
• additional documentation;
• information required by payment providers;
• information required by applicable law; and
• other information reasonably necessary to verify identity, age, account ownership, or eligibility.

Verification may be performed directly by Sugar Baby Online or by authorized third-party providers.

Third-party verification providers may process information on behalf of Sugar Baby Online in accordance with applicable law and their contractual obligations.

Providing false, altered, stolen, fraudulent, or misleading identification or verification information is strictly prohibited.

Sugar Baby Online may require re-verification at any time.

Failure to complete a required verification process may result in restrictions, suspension, termination, or loss of access to certain Platform features.

A verified status does not constitute an absolute guarantee of:

• identity;
• honesty;
• financial solvency;
• criminal history;
• safety;
• intentions;
• relationship status; or
• future conduct.

5. NATURE OF THE PLATFORM

Sugar Baby Online is a technology platform.

Sugar Baby Online is not:

• an escort agency;
• a prostitution agency;
• an escort service;
• an employment agency;
• a matchmaking agency;
• a financial institution;
• a security company;
• a private investigation company;
• a dating guarantor;
• a relationship guarantor; or
• a representative of any user.

Sugar Baby Online does not guarantee that any user will find:

• a Sugar Daddy;
• a Sugar Baby;
• a partner;
• a friendship;
• a relationship;
• a date;
• financial support;
• subscribers;
• followers;
• customers; or
• any other particular outcome.

6. USER TYPES

The Platform may include different categories of users.

6.1 Regular Users

Regular Users may use the Platform to:

• discover profiles;
• follow users;
• communicate;
• subscribe to Creators;
• purchase digital content;
• send tips;
• interact with other users; and
• use other available Platform features.

6.2 Creators / SugarBabies

Creators, including SugarBabies approved for monetization, may use Platform features to:

• publish content;
• offer subscriptions;
• sell paid posts;
• sell PPV content;
• send paid messages;
• receive tips;
• participate in other monetization programs approved by Sugar Baby Online.

Creators are subject to all applicable provisions of these Terms.

7. USER ACCOUNTS

Each person may maintain only the number of accounts expressly permitted by Sugar Baby Online.

Users may not:

• create false accounts;
• impersonate another person;
• use another person’s identity;
• use another person’s photographs without authorization;
• sell an account;
• purchase an account;
• rent an account;
• lend an account;
• transfer an account;
• share account credentials;
• create duplicate accounts to evade restrictions;
• create accounts to circumvent suspension; or
• create accounts for fraudulent purposes.

Users are responsible for maintaining the confidentiality of their login credentials.

Users must notify Sugar Baby Online if they suspect unauthorized access to their account.

8. ACCOUNT INFORMATION

Users must provide accurate, current, and complete information.

Sugar Baby Online may require users to update information for:

• identity verification;
• payment processing;
• fraud prevention;
• security;
• legal compliance;
• tax requirements; and
• regulatory requirements.

Providing false, misleading, incomplete, or fraudulent information may result in suspension or termination.

9. USER RELATIONSHIPS

Users are solely responsible for their communications, decisions, agreements, relationships, meetings, and interactions with other users.

Sugar Baby Online is not a party to any agreement between users.

Sugar Baby Online does not guarantee or verify:

• identity;
• marital status;
• employment;
• profession;
• income;
• wealth;
• financial solvency;
• intentions;
• criminal history;
• relationship status;
• photographs;
• statements;
• representations; or
• behavior.

Users are responsible for independently evaluating information provided by other users.

10. SAFETY

Users should exercise reasonable caution when interacting with people they meet online.

Sugar Baby Online recommends that users:

• do not share passwords;
• do not share authentication codes;
• do not share banking credentials;
• do not provide identity documents to strangers;
• conduct video calls before meeting;
• initially meet in public locations;
• inform a trusted person about meetings;
• avoid sending money to strangers;
• preserve evidence of threats or fraud;
• use Platform reporting mechanisms; and
• report suspicious or unlawful behavior.

These recommendations do not constitute a guarantee of safety.

11. INTERACTIONS OUTSIDE THE PLATFORM

Users may choose to communicate or interact outside SugarBabyOnline.

This may include:

• WhatsApp;
• Telegram;
• Instagram;
• Facebook;
• email;
• telephone;
• external video calls;
• travel;
• hotels;
• restaurants;
• personal meetings; and
• financial arrangements.

Any interaction outside the Platform is undertaken at the user’s own discretion and risk.

Sugar Baby Online does not control activities occurring outside the Platform.

Sugar Baby Online is not a party to and does not supervise, arrange, guarantee, facilitate, or assume responsibility for private interactions, relationships, meetings, travel, accommodations, financial arrangements, or agreements between users occurring outside the Platform.

To the maximum extent permitted by applicable law, Sugar Baby Online shall not be responsible for acts or omissions of users or third parties occurring outside the Platform.

12. PROHIBITED CONDUCT

Users may not use Sugar Baby Online to:

• commit fraud;
• scam another person;
• blackmail;
• extort;
• threaten;
• stalk;
• harass;
• impersonate;
• deceive;
• distribute malware;
• engage in human trafficking;
• exploit another person;
• exploit minors;
• distribute non-consensual intimate images;
• publish private information without authorization;
• engage in unlawful activity;
• manipulate Platform systems;
• manipulate subscriptions;
• manipulate tips;
• manipulate referrals;
• create fake engagement;
• evade moderation;
• evade suspension;
• scrape Platform data;
• use unauthorized bots;
• attack Platform infrastructure;
• reverse engineer security systems; or
• circumvent payment systems.

13. PROHIBITED TRANSACTIONAL SEXUAL SERVICES

SugarBabyOnline is a platform for adult social connections and lawful digital Creator content.

The Platform does not permit users to advertise, arrange, negotiate, facilitate, or sell:

• prostitution;
• escort services;
• sexual services in exchange for money;
• sexual encounters in exchange for compensation;
• paid sexual companionship;
• sexual services disguised as dates;
• hotel arrangements involving compensated sexual activity;
• travel arrangements involving compensated sexual activity;
• sexual acts in exchange for financial support; or
• other unlawful commercial sexual activity.

This prohibition applies regardless of whether payment is made through Sugar Baby Online or outside the Platform.

Approved Creators may monetize lawful digital adult content through Platform-approved features, subject to these Terms, applicable law, payment-provider requirements, and Platform policies.

14. CREATOR / SUGARBABY ELIGIBILITY

Creators must:

1. Be at least 18 years old.
2. Complete required identity verification.
3. Provide accurate information.
4. Provide information required for payment processing.
5. Comply with applicable tax obligations.
6. Own or control the rights necessary to publish their content.
7. Obtain all necessary consent from individuals appearing in their content.
8. Comply with these Terms and all applicable Platform policies.

Sugar Baby Online may reject, restrict, suspend, or terminate Creator accounts where permitted by applicable law.

15. CREATOR CONTENT

Creators are solely responsible for content they upload, publish, sell, transmit, or otherwise make available.

Creator Content may include:

• photographs;
• videos;
• audio;
• text;
• posts;
• paid posts;
• subscriber-only posts;
• PPV content;
• paid messages;
• profile content; and
• other digital material.

Creators represent and warrant that they possess all rights, licenses, permissions, and consents necessary to publish their content.

16. CONTENT FEATURING OTHER PEOPLE

A Creator may not upload content featuring another person unless the Creator has obtained all required rights and consent.

Every person appearing in sexual or sexually explicit Creator Content must be an adult.

Sugar Baby Online may require:

• government-issued identification;
• proof of age;
• written consent;
• model releases;
• publication authorization;
• commercial-use authorization; and
• other documentation.

Sugar Baby Online may require documentation before or after publication.

Failure to provide requested documentation may result in:

• removal of content;
• restriction of monetization;
• withholding of related earnings;
• suspension; or
• termination.

17. NON-CONSENSUAL INTIMATE CONTENT

Sugar Baby Online strictly prohibits the publication or distribution of intimate content without the consent of the person depicted.

This includes:

• revenge pornography;
• leaked intimate images;
• secretly recorded intimate content;
• intimate content obtained through deception;
• non-consensual sexual imagery;
• unauthorized publication of private sexual material;
• AI-generated intimate content depicting an identifiable person without authorization;
• deepfakes; and
• manipulated intimate imagery.

Reports of suspected non-consensual intimate content may result in immediate restriction or removal while the matter is investigated.

Sugar Baby Online may preserve evidence and cooperate with competent authorities where legally required or appropriate.

18. ARTIFICIAL INTELLIGENCE AND SYNTHETIC CONTENT

Users may not use artificial intelligence, synthetic media, deepfakes, face-swapping, or other manipulation technologies to:

• impersonate another person;
• create non-consensual intimate imagery;
• deceive users about identity;
• evade identity verification;
• manipulate verification systems;
• commit fraud;
• circumvent moderation; or
• misrepresent another person’s participation in content.

Sugar Baby Online may restrict or require disclosure of AI-generated or materially AI-manipulated content.

19. USER-GENERATED CONTENT

Users are responsible for all content they upload, send, transmit, or publish.

Users may not upload content that:

• is unlawful;
• infringes intellectual property rights;
• violates privacy rights;
• contains prohibited material involving minors;
• contains non-consensual intimate imagery;
• impersonates another person;
• contains malware;
• facilitates fraud;
• contains unauthorized personal information;
• promotes prohibited activities; or
• violates these Terms.

20. LICENSE TO SUGAR BABY ONLINE

Users retain ownership of content they own.

By uploading content to Sugar Baby Online, the user grants the Company a non-exclusive, worldwide, royalty-free, limited license to host, store, reproduce, process, transmit, display, distribute, and technically modify the content solely as necessary to:

• operate the Platform;
• provide requested services;
• display content according to user settings;
• process payments;
• moderate content;
• prevent fraud;
• protect Platform security;
• investigate violations;
• comply with legal obligations;
• create technical backups; and
• maintain Platform functionality.

This license does not transfer ownership of the content to Sugar Baby Online.

The license continues only for as long as reasonably necessary to provide the service or satisfy applicable legal, security, fraud-prevention, dispute-resolution, or backup requirements.

21. LICENSE TO PURCHASERS

When a user purchases Creator Content, the user receives a limited, personal, non-transferable right to access and view the purchased content through the Platform.

The purchase does not transfer ownership or intellectual property rights.

Users may not, without authorization:

• copy;
• download;
• reproduce;
• redistribute;
• resell;
• publish;
• upload elsewhere;
• share;
• screen-record;
• commercially exploit;
• publicly display; or
• otherwise distribute Creator Content.

22. SCREENSHOTS AND RECORDING

Users are prohibited from copying, recording, reproducing, or distributing Creator Content without authorization.

Sugar Baby Online may implement technical measures designed to discourage unauthorized copying or recording.

However, Sugar Baby Online cannot guarantee that users will be technically prevented from taking screenshots, photographs, recordings, or other copies.

Unauthorized redistribution remains prohibited regardless of whether technical prevention is successful.

23. COPYRIGHT AND INTELLECTUAL PROPERTY

Users may not upload or distribute content they do not have the legal right to use.

Sugar Baby Online may remove or restrict allegedly infringing content upon receiving a valid copyright complaint.

Repeated infringement may result in account suspension or termination.

Users who believe their copyrighted material has been infringed may contact Sugar Baby Online through the designated copyright reporting mechanism.

24. MESSAGING

Users may communicate through Platform messaging tools.

Messages are subject to these Terms.

Sugar Baby Online may process, review, retain, restrict, or disclose messages when reasonably necessary for:

• security;
• fraud prevention;
• moderation;
• investigation;
• enforcement;
• protection of users; and
• compliance with legal obligations.

Users should not assume that communications are completely private from authorized moderation, security, compliance, or legal processes.

25. MODERATION

Sugar Baby Online may use:

• automated systems;
• artificial intelligence;
• human moderators;
• user reports;
• fraud detection systems; and
• security systems.

Sugar Baby Online may:

• remove content;
• restrict content;
• limit messaging;
• restrict visibility;
• restrict monetization;
• delay earnings;
• suspend accounts;
• terminate accounts;
• preserve evidence; and
• cooperate with authorities.

The Company does not guarantee that every violation will be detected.

Failure to detect a violation does not constitute approval or endorsement.

26. REPORTING

Users may report:

• suspicious accounts;
• minors;
• fraud;
• scams;
• threats;
• harassment;
• blackmail;
• extortion;
• impersonation;
• stolen content;
• copyright violations;
• non-consensual intimate content;
• illegal content;
• payment abuse; and
• other violations.

Reports should contain sufficient information to allow investigation.

Knowingly false or malicious reports may themselves violate these Terms.

27. SUBSCRIPTIONS

Sugar Baby Online may allow users to purchase subscriptions to Creator profiles.

All subscriptions offered through Sugar Baby Online are non-recurring and non-automatic, unless the Platform expressly indicates otherwise in writing and such arrangement is permitted by applicable law.

A subscription is valid only for the specific subscription period displayed to the user at the time of purchase.

When the applicable subscription period expires, the subscription automatically ends and the user is not charged again.

Sugar Baby Online does not automatically renew subscriptions and does not automatically charge users for a subsequent subscription period.

Before completing a subscription purchase, the Platform will display applicable material information, including:

• price;
• currency;
• subscription duration;
• applicable access period;
• Creator associated with the subscription; and
• material purchase conditions.

If a user wishes to continue accessing a Creator’s subscription after expiration, the user must voluntarily initiate and complete a new subscription purchase.

Each new subscription constitutes a separate transaction.

28. TIPS

Sugar Baby Online may allow users to voluntarily send tips to Creators.

A tip is a voluntary payment and does not constitute:

• a loan;
• an investment;
• a financial guarantee;
• a guarantee of personal interaction;
• a guarantee of a relationship;
• payment for prostitution;
• payment for an escort service; or
• payment for unlawful sexual activity.

Tips are subject to payment, commission, chargeback, fraud-prevention, and account policies.

29. PAID POSTS, PPV AND PAID MESSAGES

Creators may offer paid digital content through Platform features.

This may include:

• paid posts;
• PPV content;
• paid messages;
• paid media;
• bundles; and
• other approved digital products.

The applicable price will be displayed before purchase.

Purchasing paid content grants the purchaser only a limited right to access the content through the Platform.

The purchase does not transfer ownership or intellectual property rights.

30. PLATFORM COMMISSION — 20% / CREATOR SHARE — 80%

For qualifying monetized transactions processed through Sugar Baby Online, Sugar Baby Online retains twenty percent (20%) of the applicable gross amount as its Platform commission, and the Creator receives eighty percent (80%) of the applicable gross amount as the Creator’s gross share.

For example:

User payment: $100.00

• Sugar Baby Online Platform commission: 20% = $20.00
• Creator gross share: 80% = $80.00

The 80% Creator share is the Creator’s gross earnings before any applicable:

• payment-processing fees;
• chargebacks;
• payment reversals;
• legally required tax withholdings;
• payment-provider adjustments;
• currency conversion;
• payout fees;
• fraud-related adjustments;
• duplicate transaction adjustments; or
• other deductions expressly disclosed by the Platform or required by law.

Unless otherwise expressly stated, the applicable 20% Platform commission applies to qualifying monetized transactions processed through Sugar Baby Online, including applicable subscriptions and tips.

If Sugar Baby Online applies a different commission to a particular monetization feature, the applicable rate will be disclosed to the Creator before or when that feature is used.

The Platform commission compensates Sugar Baby Online for services including, where applicable:

• technology infrastructure;
• hosting;
• content delivery;
• payment functionality;
• security;
• moderation;
• fraud prevention;
• customer support;
• account management;
• Platform development; and
• other services necessary to operate the Platform.

Sugar Baby Online may modify its commission structure in the future. Material changes applicable to existing Creators will be communicated through reasonable means and, where applicable, applied prospectively.

31. PRICES, PURCHASE INFORMATION AND PAYMENT TERMS

Before completing a purchase, users will be provided with applicable material purchase information, subject to applicable law.

Depending on the transaction, the Platform may display:

• the price;
• applicable taxes;
• applicable additional charges;
• currency;
• payment method;
• subscription duration;
• access period;
• whether the payment is one-time or recurring;
• applicable cancellation or expiration conditions;
• material restrictions or limitations; and
• other material terms applicable to the transaction.

Users are responsible for reviewing the applicable purchase information before confirming a transaction.

Sugar Baby Online will not intentionally impose undisclosed charges that were not presented as applicable to the transaction, except where an additional charge is required by law or results from the user’s selected payment method or other disclosed circumstances.

Prices, promotional offers, discounts, and other commercial conditions may change from time to time.

Changes will generally apply prospectively and will not retroactively alter completed transactions unless required by applicable law.

32. PURCHASE CONFIRMATION AND TRANSACTION RECORDS

Following a successful transaction, Sugar Baby Online or its applicable payment provider may provide the user with an electronic confirmation, receipt, transaction record, or other confirmation containing relevant transaction information.

Transaction records may include, where applicable:

• transaction or order identification number;
• date and time;
• description of the purchased subscription, content, tip, or service;
• amount charged;
• currency;
• applicable taxes or charges;
• payment status; and
• other information reasonably necessary to document the transaction.

Users should retain their transaction confirmations and payment records.

Where applicable, users may be provided with information regarding how to obtain an electronic invoice or other legally required fiscal documentation.

Sugar Baby Online may retain electronic transaction records for accounting, security, fraud prevention, legal, tax, dispute-resolution, and compliance purposes, subject to applicable law and the Privacy Policy.

33. PAYMENTS

Payments may be processed by third-party payment providers.

Where payment processing is performed by a third party, Sugar Baby Online may not directly store complete payment-card information.

Users authorize Sugar Baby Online and its authorized payment providers to process transactions initiated through the Platform.

Transactions may be declined, delayed, reversed, or subject to additional verification due to:

• fraud prevention;
• security;
• payment-provider requirements;
• legal compliance;
• suspicious activity;
• insufficient funds;
• payment-method restrictions; or
• technical problems.

34. NO REFUNDS — ALL SALES ARE FINAL

All purchases made through Sugar Baby Online are final and non-refundable, to the maximum extent permitted by applicable law.

This includes, without limitation:

• subscriptions;
• new subscription purchases;
• tips;
• paid posts;
• PPV content;
• paid messages;
• bundles;
• digital content;
• other paid digital services; and
• other transactions made through the Platform.

Sugar Baby Online does not provide refunds, credits, reimbursements, or partial refunds merely because a user:

• changes their mind;
• no longer wants a subscription;
• no longer wants the content;
• does not use purchased content;
• does not interact with a Creator;
• blocks or unfollows a Creator;
• stops using the Platform;
• deletes their account;
• does not access purchased content;
• is dissatisfied with a Creator’s content or profile; or
• otherwise decides not to use the purchased service.

Because subscriptions are non-recurring and non-automatic, there is no automatic renewal to cancel.

Each subscription is a separate purchase voluntarily initiated by the user.

Nothing in this section is intended to exclude, restrict, or waive any consumer right, refund, cancellation right, reimbursement, remedy, or other protection that cannot legally be excluded or limited under applicable law.

Where applicable law requires a refund or other remedy, Sugar Baby Online will comply with that legal requirement.

35. CHARGEBACKS AND PAYMENT DISPUTES

Users must not initiate fraudulent, abusive, or intentionally misleading chargebacks.

If a transaction is reversed, disputed, charged back, refunded by a payment provider, or otherwise returned after funds have been credited to a Creator, Sugar Baby Online may, to the maximum extent permitted by law:

• deduct the corresponding amount from available Creator funds;
• deduct the amount from future Creator earnings;
• delay or withhold payouts;
• recover amounts previously credited;
• restrict monetization;
• suspend an account; or
• terminate an account where appropriate.

Sugar Baby Online may temporarily withhold funds while investigating suspected:

• fraud;
• payment disputes;
• unauthorized transactions;
• account compromise; or
• violations of these Terms.

A chargeback does not automatically establish wrongdoing. Sugar Baby Online may review available information and take reasonable action based on the circumstances.

36. CREATOR EARNINGS

Creators earn amounts generated through qualifying monetization features according to the applicable commission structure.

For transactions subject to the standard Platform commission:

80% = Creator gross share

20% = Sugar Baby Online Platform commission

Creator earnings may be adjusted due to:

• chargebacks;
• payment reversals;
• fraudulent transactions;
• legally required adjustments;
• payment-provider adjustments;
• currency conversion;
• tax withholding;
• duplicate transactions;
• technical errors; or
• violations of these Terms.

Sugar Baby Online does not guarantee any minimum number of:

• subscribers;
• followers;
• tips;
• purchases;
• views;
• messages; or
• earnings.

37. CREATOR PAYOUTS

Creators may request withdrawal of eligible earnings through payment methods made available by Sugar Baby Online.

Sugar Baby Online may require:

• identity verification;
• age verification;
• payment verification;
• banking information;
• tax information; and
• security verification.

Certain earnings may remain pending for a settlement period before becoming eligible for withdrawal.

Sugar Baby Online may delay, suspend, or withhold payouts when reasonably necessary to investigate:

• fraud;
• chargebacks;
• payment disputes;
• suspicious transactions;
• account compromise;
• identity concerns;
• violations of these Terms;
• unlawful activity;
• payment-provider requirements; or
• legal obligations.

After an investigation, applicable funds may be released, adjusted, reversed, or otherwise handled according to these Terms and applicable law.

Nothing in this section authorizes Sugar Baby Online to unlawfully confiscate funds belonging to a Creator.

38. CREATOR PAYOUT AND BANKING INFORMATION

Creators who wish to receive earnings through SugarBabyOnline may be required to provide accurate and valid payout information, including bank account information and other information necessary to process Creator payments.

Sugar Baby Online may require additional identity, tax, banking, or verification information before allowing a Creator to receive payouts.

Creators are responsible for ensuring that all payout information they provide is accurate, current, and legally authorized for their use.

Sugar Baby Online is not responsible for payout delays, failed transfers, or losses resulting from incorrect, incomplete, outdated, fraudulent, or unauthorized payout information supplied by a Creator.

Sugar Baby Online may use third-party payment processors, banking institutions, payout providers, identity-verification providers, and other service providers to process payments and Creator payouts.

39. CREATOR TAX RESPONSIBILITIES

Creators are solely responsible for their tax obligations arising from their use of Sugar Baby Online.

This may include:

• income taxes;
• applicable VAT;
• invoicing;
• registration;
• reporting; and
• withholding obligations.

Sugar Baby Online does not provide tax, accounting, or legal advice.

The Company may request tax information where required by law or payment providers.

40. OFF-PLATFORM PAYMENTS

Users and Creators may not use Sugar Baby Online to circumvent the Platform’s payment system.

Creators may not instruct users to make external payments for transactions that should reasonably be processed through Sugar Baby Online.

This may include:

• PayPal;
• Venmo;
• Cash App;
• Zelle;
• bank transfers;
• cryptocurrency;
• Mercado Pago;
• Wise;
• external payment links;
• gift cards; and
• other external payment methods.

This prohibition applies when the external payment is intended to replace, avoid, or circumvent:

• a subscription;
• a tip;
• a paid post;
• PPV content;
• a paid message;
• Platform commission; or
• another monetized Platform transaction.

Violations may result in content removal, monetization restrictions, payout withholding, suspension, or termination.

41. CREATOR CONTENT PURCHASES

Creators acknowledge that users purchase access to digital content and not ownership of the underlying content.

Creators remain responsible for the legality, accuracy, and rights associated with content they publish.

Users may not exploit purchased content outside the rights granted by these Terms.

42. REFERRAL AND AFFILIATE PROGRAMS

Sugar Baby Online may offer referral or affiliate programs.

Referral commissions are subject to the applicable Referral Program Terms.

Sugar Baby Online may reject, reverse, or cancel referral commissions resulting from:

• fake accounts;
• self-referrals;
• fraudulent registrations;
• bots;
• duplicate accounts;
• manipulation;
• chargebacks;
• abuse; or
• prohibited conduct.

Referral programs do not create a partnership, employment relationship, agency, franchise, or ownership interest in Sugar Baby Online.

43. MANIPULATION AND FAKE ENGAGEMENT

Users may not artificially manipulate:

• followers;
• subscribers;
• likes;
• tips;
• views;
• messages;
• rankings;
• recommendations;
• referrals;
• earnings; or
• engagement.

This includes the use of:

• bots;
• fake accounts;
• purchased engagement;
• stolen payment methods;
• coordinated fraudulent transactions; or
• automated systems.

44. BOTS, SCRAPING AND AUTOMATED ACCESS

Without written authorization, users may not:

• scrape Platform data;
• crawl Platform pages;
• extract profiles;
• collect photographs;
• collect Creator Content;
• use automated messaging;
• use bots;
• use unauthorized APIs;
• bypass rate limits;
• reverse engineer security mechanisms; or
• automate account creation.

Sugar Baby Online may block technical access associated with prohibited automated activity.

45. PRIVACY AND PERSONAL DATA

Sugar Baby Online recognizes the importance of protecting users’ personal information.

The processing of personal information is governed by the SugarBabyOnline Privacy Notice / Privacy Policy.

The Privacy Policy forms part of this Agreement.

Sugar Baby Online may collect and process information necessary to operate, secure, verify, administer, and provide the Platform.

Depending on the user’s activities, this information may include:

• full name;
• email address;
• telephone number;
• date of birth;
• age-related information;
• government-issued identification information;
• INE, passport, driver’s license, or other identification documents;
• photographs and selfies used for verification;
• facial verification or liveness information;
• electronic signatures;
• bank account and payout information;
• payment-related information;
• tax information;
• account credentials;
• IP address;
• device information;
• technical and security information;
• communications;
• transaction information;
• subscription information;
• tip and purchase information;
• payout information;
• chargeback and dispute information; and
• other information necessary for the operation and protection of the Platform.

Some information may constitute sensitive, financial, biometric, or otherwise specially protected personal information under applicable law.

Sugar Baby Online may process this information for purposes including:

• account creation and administration;
• age and identity verification;
• Creator approval;
• payment processing;
• Creator payouts;
• fraud prevention;
• security;
• moderation;
• customer support;
• legal and regulatory compliance;
• tax and accounting requirements;
• dispute resolution;
• enforcement of these Terms; and
• protection of users and the Platform.

Sugar Baby Online may use authorized third-party service providers to process personal information on its behalf.

46. ACCESS TO PERSONAL AND SENSITIVE INFORMATION

Sugar Baby Online will use reasonable technical and organizational measures designed to restrict access to personal, identity-verification, banking, payment, and other confidential information.

Access to such information will be limited to authorized personnel, contractors, service providers, or other parties who have a legitimate need to access the information for authorized business, security, legal, compliance, payment, verification, or operational purposes.

Sugar Baby Online does not authorize developers, contractors, moderators, or other personnel to access confidential user information merely because they have technical access to Platform systems.

Where technically and operationally feasible, access controls, permissions, authentication, logging, and other security measures may be used to limit unauthorized access.

Additional information regarding security, data processing, data retention, transfers, disclosures, and user rights is provided in the Privacy Policy.

47. VERIFICATION INFORMATION

Where identity or age verification is required, verification information may be processed by Sugar Baby Online or authorized third-party providers.

Verification information may include:

• government-issued identification;
• INE or equivalent identification;
• passport;
• selfie;
• facial verification;
• liveness information;
• date of birth;
• verification results;
• electronic signatures; and
• related verification records.

Users acknowledge that verification may require sensitive or highly personal information depending on the verification method.

The collection, use, storage, transfer, security, and deletion of such information are governed by the Privacy Policy and applicable law.

48. DATA RETENTION

Deleting an account does not necessarily result in immediate deletion of every record.

• fraud prevention;
• security;
• chargebacks;
• payment disputes;
• investigations;
• dispute resolution;
• enforcement of agreements;
• protection of legal rights;
• accounting;

• backup systems.

Retention will be handled in accordance with applicable law and the Privacy Policy.

49. ACCOUNT DELETION

Users may request account deletion through available Platform mechanisms.

Deletion may result in:

• loss of account access;
• removal or disabling of the profile;
• termination of certain services; and
• loss of access to Platform features.

Pending transactions may continue to be processed.

Information required to be retained by law or reasonably necessary for security, fraud prevention, disputes, chargebacks, transaction records, or legal claims may remain retained.

50. SECURITY

Sugar Baby Online implements reasonable technical and organizational measures designed to protect the Platform and information processed through it.

However, no online service can guarantee absolute security.

Users acknowledge that:

• Internet transmissions carry inherent risks;
• no system is completely immune to attacks;
• third-party services may experience security incidents; and
• users are responsible for protecting their credentials.

51. THIRD-PARTY SERVICES

Sugar Baby Online may use third-party services including:

• payment processors;
• identity verification providers;
• hosting providers;
• cloud infrastructure;
• analytics providers;
• email providers;
• content delivery networks;
• customer-support systems; and
• payout providers.

Third-party providers may have their own terms and privacy policies.

Sugar Baby Online is not responsible for independent acts or omissions of third parties except where liability cannot legally be excluded.

52. PLATFORM AVAILABILITY

Sugar Baby Online will make reasonable efforts to maintain Platform availability.

However, the Company does not guarantee that the Platform will be:

• uninterrupted;
• permanent;
• error-free;
• completely secure;
• free from vulnerabilities;
• compatible with every device; or
• compatible with every browser.

The Platform may become unavailable due to:

• maintenance;
• updates;
• technical failures;
• cyberattacks;
• infrastructure failures;
• third-party failures;
• Internet problems;
• force majeure; or
• legal requirements.

Nothing in this section excludes liability for matters that cannot legally be excluded.

53. SUSPENSION

Sugar Baby Online may temporarily suspend an account when reasonably necessary to:

• investigate violations;
• protect users;
• investigate fraud;
• investigate payment disputes;
• protect Platform security;
• comply with law;
• investigate identity concerns; or
• prevent abuse.

Suspension may restrict:

• messaging;
• publishing;
• subscriptions;
• monetization;
• withdrawals;
• account access; and
• other Platform functions.

54. TERMINATION

Sugar Baby Online may terminate an account where permitted by applicable law if the user:

• violates these Terms;
• engages in fraud;
• engages in unlawful activity;
• involves minors;
• publishes prohibited content;
• commits harassment;
• commits blackmail;
• engages in extortion;
• impersonates another person;
• attempts to evade suspension;
• manipulates Platform systems;
• repeatedly violates Platform policies; or
• creates material risk to users or the Platform.

Termination may result in loss of Platform access.

55. EARNINGS AFTER TERMINATION

If a Creator account is terminated, pending earnings may be:

• released;
• delayed;
• adjusted;
• reversed; or
• withheld

to the extent reasonably necessary to address:

• chargebacks;
• payment reversals;
• fraud;
• payment disputes;
• unlawful activity;
• violations of these Terms; or
• legal obligations.

Nothing in this provision authorizes Sugar Baby Online to unlawfully confiscate funds belonging to a Creator.

56. APPEALS

Where an appeal mechanism is available, users may request review of certain:

• moderation decisions;
• suspensions;
• terminations;
• monetization restrictions; or
• earnings decisions.

Appeals should contain sufficient information to allow review.

Sugar Baby Online may review appeals through automated or human processes.

The Company may uphold, modify, or reverse a decision.

Urgent actions involving minors, illegal content, fraud, security, or legal obligations may be subject to special procedures.

57. USER WARRANTIES

By using Sugar Baby Online, the user represents and warrants that:

1. They are at least 18 years old.
2. They have authority to enter into these Terms.
3. Their information is accurate.
4. They own or have rights to content they upload.
5. They have obtained required consent from individuals appearing in content.
6. They will comply with applicable laws.
7. They will not use the Platform for unlawful activities.
8. They will not interfere with Platform security.
9. They will not abuse payment systems.
10. They will not attempt to evade moderation or suspension.

58. INDEMNIFICATION

To the maximum extent permitted by applicable law, the user agrees to defend, indemnify, and hold harmless Sugar Baby Online, its owners, officers, employees, contractors, affiliates, representatives, and service providers from claims, losses, damages, liabilities, costs, and reasonable expenses arising from:

• violation of these Terms;
• unlawful conduct;
• content uploaded by the user;
• infringement of third-party rights;
• fraud;
• misuse of the Platform;
• unauthorized transactions;
• disputes with other users;
• unauthorized use of another person’s identity; or
• breach of applicable law.

Nothing in this provision limits rights that cannot legally be waived.

59. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUGAR BABY ONLINE SHALL NOT BE LIABLE FOR THE ACTS OR OMISSIONS OF USERS OR THIRD PARTIES.

This includes, to the extent legally permitted:

• fraud;
• scams;
• extortion;
• blackmail;
• threats;
• theft;
• assault;
• personal injury;
• property damage;
• financial losses;
• relationship disputes;
• personal meetings;
• travel;
• activities outside the Platform;
• unauthorized disclosure of information by users;
• user-generated content;
• agreements between users; and
• money transfers between users.

Sugar Baby Online does not control or guarantee the conduct of users.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

60. NO GUARANTEE OF USER CONDUCT

Sugar Baby Online does not guarantee that:

• profiles are truthful;
• users are financially capable;
• users behave honestly;
• users honor agreements;
• users attend meetings;
• users provide promised support;
• users remain on the Platform;
• users behave safely; or
• content remains available.

Users are responsible for their own decisions regarding other users.

61. INTELLECTUAL PROPERTY OF SUGAR BABY ONLINE

The Platform and its proprietary elements may include:

• software;
• source code;
• interfaces;
• designs;
• graphics;
• logos;
• trademarks;
• names;
• text;
• databases;
• algorithms;
• visual elements; and
• functionality.

These elements are owned by Sugar Baby Online or their respective licensors.

Users may not copy, modify, distribute, sell, reverse engineer, reproduce, or commercially exploit them without authorization.

62. FEEDBACK

Users may provide suggestions, recommendations, or feedback regarding the Platform.

Unless otherwise agreed in writing, Sugar Baby Online may use such feedback without compensation or obligation.

Users should not submit confidential information as feedback.

63. ELECTRONIC ACCEPTANCE AND RECORDS

Electronic acceptance of these Terms constitutes the user’s expression of consent to this Agreement to the extent permitted by applicable law.

Sugar Baby Online may maintain records of:

• date and time of acceptance;
• account identifier;
• version of Terms accepted;
• IP address;
• technical information;
• consent records; and
• applicable policy version.

Such records may be retained as reasonably necessary to demonstrate acceptance, prevent fraud, resolve disputes, comply with law, or protect legal rights.

64. ELECTRONIC CONTRACTING AND PURCHASE CONFIRMATION

Where users purchase subscriptions, digital content, tips, or other paid services, Sugar Baby Online may provide electronic confirmation or transaction records.

Before completing a purchase, users will be provided with the material information applicable to the transaction, to the extent required by law.

Users are responsible for reviewing transaction information before completing a purchase.

Sugar Baby Online may retain electronic records relating to transactions.

65. CHANGES TO THESE TERMS

Sugar Baby Online may modify these Terms when reasonably necessary because of:

• legal requirements;
• regulatory changes;
• Platform changes;
• security requirements;
• payment-provider requirements;
• new features; or
• operational changes.

Material changes will be communicated through reasonable means where required.

The updated version will be made available through the Platform.

Where applicable law requires renewed consent, Sugar Baby Online will request such consent.

66. POLICIES INCORPORATED INTO THESE TERMS

The following documents may form part of the contractual relationship between the user and Sugar Baby Online:

• Community Guidelines;
• Creator/SugarBaby Terms;
• Chargeback Policy;
• Creator Earnings & Payout Policy;
• Copyright Policy;
• Non-Consensual Intimate Content Policy;
• Adult Content Policy;
• Referral Program Terms;
• Cookie Policy; and
• other policies expressly incorporated into the Platform.

Where a specific policy governs a particular subject, that policy may control that subject matter in the event of a conflict, to the extent permitted by applicable law.

67. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by applicable law.

68. NO WAIVER

Failure by Sugar Baby Online to enforce any provision of these Terms does not constitute a waiver of the Company’s right to enforce that provision later.

69. ASSIGNMENT

Users may not assign or transfer their rights or obligations under these Terms without the Company’s prior written authorization.

Sugar Baby Online may assign or transfer its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, corporate reorganization, or similar transaction, subject to applicable law.

70. ENTIRE AGREEMENT

These Terms, together with the Privacy Notice and policies expressly incorporated into them, constitute the agreement between the user and Sugar Baby Online regarding use of the Platform.

These Terms supersede previous versions concerning the same subject matter, except where expressly stated otherwise.

71. GOVERNING LAW

These Terms shall be governed by the applicable laws of the United Mexican States, without prejudice to mandatory consumer-protection, privacy, data-protection, electronic-commerce, or other rights that may apply to users under applicable law.

Nothing in these Terms is intended to waive mandatory rights that cannot legally be waived.

72. JURISDICTION AND COMPETENT AUTHORITIES

Any dispute arising from or relating to these Terms shall be submitted to the competent authorities and courts having jurisdiction under applicable law.

Nothing in this section prevents a consumer from exercising mandatory rights before a competent consumer-protection authority or court where such rights cannot legally be waived.

Nothing in these Terms shall be interpreted as preventing a user from exercising rights before the competent Mexican consumer-protection authorities, including PROFECO, when applicable.

73. CONSUMER RIGHTS AND ELECTRONIC COMMERCE

Nothing in these Terms is intended to eliminate, restrict, or waive mandatory consumer rights applicable to transactions made through the Platform.

Where Mexican consumer-protection law applies, Sugar Baby Online will comply with applicable legal requirements concerning electronic commerce, consumer information, transaction records, payments, applicable cancellation mechanisms, privacy, and consumer rights.

The Platform will seek to provide users with clear and truthful information concerning:

• prices;
• applicable charges;
• currency;
• subscription duration;
• payment procedures;
• applicable purchase conditions;
• cancellation or expiration terms;
• privacy information;
• transaction confirmations; and
• other information required by applicable law.

Where applicable law grants a consumer a right that conflicts with a provision of these Terms, the mandatory legal right will prevail to the extent required by law.

• I understand that Sugar Baby Online is a technology platform.
• I understand that Sugar Baby Online does not guarantee the identity, honesty, financial status, safety, or behavior of other users.
• I understand that interactions with other users involve inherent risks.
• I understand that Sugar Baby Online is not a party to private agreements between users.
• I understand that interactions, meetings, travel, financial arrangements, relationships, or other activities occurring outside the Platform are undertaken at my own discretion and risk.
• I understand that Sugar Baby Online does not control, supervise, guarantee, or assume responsibility for private interactions between users outside the Platform, except where liability cannot legally be excluded.
• I understand that prostitution, escort services, sexual services for compensation, trafficking, exploitation, and other unlawful activities are prohibited.
• I understand that lawful adult-oriented and sexually explicit digital content may be permitted subject to the Platform’s rules and applicable law.
• I understand that absolutely no sexual or sexually explicit content involving persons under 18 is permitted.
• I understand that CSAM, grooming, sexual exploitation of minors, and other illegal sexual content are strictly prohibited.
• I understand that I am responsible for content I upload.
• I understand that I must possess the necessary rights and permissions for content I upload.
• I understand that content featuring other people may require proof of age and consent.
• I understand that non-consensual intimate imagery is prohibited.
• I understand that unauthorized AI-generated intimate imagery and deepfakes are prohibited.
• I understand that Creator Content may not be copied, redistributed, resold, recorded, or otherwise exploited without authorization.
• I understand that Sugar Baby Online retains a 20% Platform commission from qualifying monetized transactions and that the Creator receives 80% of the applicable gross amount, subject to applicable adjustments and deductions.
• I understand that the 80% Creator share is gross earnings and may be subject to applicable payment-processing fees, chargebacks, taxes, currency conversion, payout fees, or other lawful deductions disclosed by the Platform.
• I understand the applicable price, currency, subscription duration, payment method, and material purchase conditions before completing a transaction.
• I understand that Sugar Baby Online may provide electronic transaction confirmations and maintain transaction records.
• I understand that Sugar Baby Online subscriptions do not automatically renew or automatically charge another subscription period unless expressly indicated otherwise and permitted by applicable law.
• I understand that each subscription purchase is a separate transaction that I must voluntarily initiate.
• I understand that a subscription ends when its purchased subscription period expires.
• I understand that if I wish to continue a subscription after its expiration, I must voluntarily purchase a new subscription.
• I understand that all purchases through Sugar Baby Online are final and non-refundable, except where a refund or other remedy is required by applicable law.
• I understand that fraudulent or abusive chargebacks may result in account restrictions.
• I understand that Creators are responsible for their applicable tax obligations.
• I understand that Creators may be required to provide banking, payout, tax, identity, and verification information in order to receive their earnings.
• I understand that Sugar Baby Online may collect and process personal information, including identity information, government-issued identification, INE information, selfies, facial verification or liveness information, banking information, payment information, transaction information, and other information as described in the Privacy Policy.
• I understand that certain information may be sensitive, biometric, financial, or otherwise specially protected under applicable law.
• I understand that authorized third-party providers may process information on behalf of Sugar Baby Online for identity verification, payment processing, security, fraud prevention, hosting, communications, and other legitimate operational purposes.
• I understand that access to confidential personal, identity, verification, banking, and payment information is restricted to authorized persons and service providers with a legitimate need to access such information.
• I understand that payment evasion and unauthorized off-platform transactions are prohibited.
• I understand that Sugar Baby Online may moderate content and accounts.
• I understand that Sugar Baby Online may suspend or terminate accounts that violate these Terms.
• I understand that Sugar Baby Online may retain certain information after account termination when legally or operationally necessary.
• I understand that Sugar Baby Online cannot guarantee uninterrupted or completely secure service.
• I understand that personal information will be processed in accordance with the Privacy Policy and applicable law.
• I agree to comply with all applicable laws and Platform policies.

By creating an account, purchasing a service, subscribing to a Creator, or otherwise using the Platform, I acknowledge that I have read, understood, and agreed to these Terms and Conditions.
